These General Conditions of Use and Sale (hereinafter, “the General Conditions”) govern the access and use of the website through the domain name realalcazar.artymax.net property of the UTE: Viajes Alsa SAU, Pancho Tours SL (hereinafter “UTE”), which is the intermediary for the sale of audio guides of the Board of Trustees of the Real Alcázar of Seville and the Town Hall (hereinafter, the Board of Trustees).

Simple access to the Website attributes to the user the condition of user (hereinafter, "the User") and implies acceptance of all the terms included in these General Conditions. If you do not agree with these General Conditions, the User must abandon any audio guide purchase transaction through the website realalcazar.artymax.net.

These conditions will be applicable to all contracts made through the website realalcazar.artymax.net to obtain audio guides in Spanish territory.

By accepting these General Conditions, the User declares:

  2. Access to the Website
    Simple access to the Website is free except for the cost of the connection through the telecommunications network provided by the access provider contracted by the User, which will be borne by the User.
  3. Rules of use of the Website
    The User undertakes to use the Website and all its content and services in accordance with the provisions of the law, morality, public order and these General Conditions, not being able to carry out illegal activities or activities that constitute a crime that violate the rights of third parties and/or that violate any rules of the applicable legal system.
  4. Object of the contract

The purpose of this contract is to regulate the contractual relationship for the purchase and sale of audio guides for the Real Alcázar of Seville and the Town Hall between UTE Viajes Alsa, Pancho Tours and the User at the time that the latter accepts during the online contracting process the corresponding box.
  6. The purchase of audio guides for the Real Alcázar of Seville and the Town Hall does not entail the right to access them.
  7. Recruitment procedure
    1. The User, after reading these general conditions and their acceptance, and providing the information requested in the registration form, may purchase audio guides of the Real Alcázar of Seville and the Town Hall through the site web realalcazar.artymax.net
    2. In any case, the verification of the terms of the order will be the sole responsibility of the User and the purchase process cannot be started until the User has sent the confirmation of the terms of the order.
    3. It is reported that in accordance with the requirements of art. 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:

  8. Price and additional expenses
    1.   9. Right of withdrawal in the purchase of audio guides

    In this sense, the User may not exercise the right of withdrawal or resolution provided for in the consumer and user regulations, as said right is excluded for services related to leisure or recreation activities, in accordance with the provisions of the Article 103 of the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.
  10. Refund
    Once the audio guide has been purchased by the User, its amount will not be changed or refunded.
  11. Doubts and complaints

  12. Nullity and ineffectiveness of the clauses
    If any clause included in these General Conditions were declared totally or partially, null or ineffective, such nullity or ineffectiveness will only affect said condition or the part of it that is null or ineffective, subsisting the remaining General Conditions in everything else.
  13. Modification of the General Conditions and other contents
    The General Conditions will be available to the User on the Website. UTE Viajes Alsa, Pancho Tours reserves, for reasons of the service to be provided, the right to modify these General Conditions at any time, which will inform the user in a timely manner.
  14. Applicable law
    These General Conditions will be governed and interpreted in accordance with Spanish law. Among others, by Royal Legislative Decree 1/2007 of the General Law for the Defense of Consumers and Users, and Law 34/2002 on services of the information society and electronic commerce.
  15. Competent jurisdiction
    Any controversy that arises or is related to the use of the website or with these General Conditions will be submitted to the jurisdiction of the Spanish courts and tribunals. In the event that you are a consumer, you may file the claim in the city where you are domiciled in accordance with applicable law.
